On my agreement with my oldest daughter, in our paperwork, whoever pays for more than 50% of the child’s expensive and is the custodial parent, claims the child in their taxes. Which is me and next year will be her step father. He might be doing it so he can try to get the EIC which does give you more. The biggest thing is making sure he doesn’t file before you or you can takr him to court for it. Because you can both get in trouble if you both try to claim him, then both returns are put on hold.
You can ask google or call and ask a lawyer to be sure if you both claim him the burden of proof is on him to prove he pays 50 percent of his expenses for sure you can prove it

He only sees his child 1 day a week and only pays $260 a month. That’s a big no to claiming on taxes for me. If it was 50/50 then maybe would consider it. Doesn’t seem fair. Is he crazy?!
I had the agreement with my ex in my court papers. As long as his child support is current when I do mine he can claim them. If not it’s a no go !!
I had sole custody of my son. His father claimed him every other year. But it was in the custody agreement. So if it’s not in writing, i believe you have all rights to say no.

Personally I believe if parents split up and are both in the childs life actively 50/50 the money given should be split between the 2 parents especially if both parents are putting the same effort and money to raise the child but people are too selfish to give money to the other parent and feel only one parent deserves it
