How can I go about getting child support?

How do I go about this with the state? I live in MA and my son’s father is behind $10K in child support. He’s been out of my son’s life for four years now with the occasional seeing him on holidays as long as it’s supervised and I am present. We don’t ever hear from him except maybe every 3-5 months and it’s always a random text. Our child support order is set up through the state/court system and whenever he’s worked a job in the past, the amount automatically gets taken from his check and deposited into my bank account. Well I just heard from his mother that he got a job/has been working at BJ’s which is news to me. I don’t know which location because she didn’t give any more information than that. The case managers in my state are usually pretty nice but often give vague answers and solutions. I’m just confused since his paycheck is hooked up to his social why I haven’t seen a dime of child support in literal years? I know it’s a relatively new job for him but I feel like usually i would have seen something by now. So is it my job to report that he has a new job to the state? The problem is i don’t know the exact location, only the company. How do I go about this with a case support manager in hopes to get at least some of the money he is behind on? Thanks in advance.

You need to call your Caseworker and give them the updated information you have. They take it from there.

In California, I can report updated information online. Addresses, new jobs, etc

They have to send his current employer a request letter to garnish his wages, they have 30 days to respond. Then they have 30 more days to pay. Unfortunately, it’s not automatic reduction, each employer has to approve the garnishment.

It takes the courts sometimes at least month + to start removing wages from a new job.

It’s probably cause they garnish that from mens paychecks to where they can’t even support themselves. However he still needs to find a way to pay by working more

Write to your Attorney General.

In PA , my caseworker is on top of child support however it’s my job to report any information I receive. I usually don’t have to do that because my caseworker handles it. But I do have to call or email every month he doesn’t pay. It’s annoying but there’s not much else I can do. This year since the last judge put stipulations in place, my ex has missed a payment so far and we have contempt of court coming up.

It takes a while for them to get child support established when the non-custodial parent starts a new job. It wouldn’t hurt for you to report that he’s working, but they most likely already know and are processing it. I know it sucks, my sons father job hopped and when he did pay support, it wasn’t much at all compared to what he was ordered to pay. Don’t stress it though. Child support never goes away. He will just keep accruing arrearages, it will keep building up. Keep doing what you’re doing to take care of your child. By the sounds of it, you’ll be getting child support long after your child is grown and out on their own!

Go to social services and file a claim

Normally they can find out that information. Its actually his job to report it but you can as well. Just let them know hes working at bjs your just not sure what location. Also tell then you want to go back to court because of his arrears and have the courts order extra payment each month to pay off his arrears. They can contact the company and give them his information to have them start garnishing his wages weekly or bi weekly

I live in Florida and have been in the Child support system in a very long time ! The system automatically with the s.s pulls up any current employer and automatically sends to the company in which he works to HR the deduction of support . You need to call your local child support office and advise you haven’t received any payment and they will look into it . :grinning:

Usually the father is supposed to report it. But sometimes the system will recognize it and take it right away without notification of employment change. If you have t he info you can call and update it yourself. My ex used to give me the info and have me do it for him before he got with his current girlfriend, Now he usually jumps jobs when he notices money being taken out.
Call and give your case worked the information you have and they can do the rest.

Yes, give your caseworker any information that you have. He’s that far behind because he doesn’t want to pay, so he will not volunteer that information. He will never willingly pay. It will always have to be garnished, and you need to accept that you may never see a penny. There’s good money to be made behind a bar. Then if you do get a payment, it’s like a surprise bonus.

My husband is an employer and we have had employees work for us for up to 3 months, quit and THEN we receive paperwork from the county to report their income month 4-5. It doesn’t always get flagged right away and sent out to the employer unfortunately.

He probably changes jobs frequently to avoid garnishment. But the company’s corporate office has employee’s information but keep it confidential unless court ordered. Going through the state child support office and any information you have is a start.

Go to DHR. Apply for tanf. They will get the ball rolling. Also if you have a court ordered child support agreement and you know where he works and lives you can go to the courthouse and full out an affidavit to have child support deducted from his paycheck.

Give the child support office the info you know. They should be able to find his job information through the system they use. It happened years ago with me…I went down to the office told them what I knew and they found him.

In maine there’s a portal online where you can provide information about the non custodial parent if you have any at all, it helps give them a starting point. They’re all overworked and have more cases than they can handle (not their fault personally) I feel your pain. My ex quits jobs so he doesn’t have to pay, currently doesn’t have a license because the state revoked it. I feel your pain I m sorry mama

I would give your caseworker the information you have about his new job and let them take it from there.

Call child support and tell them where he works.

If he is working, call child support office and tell them. My ex is behind at least 6,000 . I would rather him sign rights over. But that’s just me. But he is very unstable.

Get a printout of current arrears (make and keep a copy for yourself) along with a copy of your court order and send a certified letter to the IRS and State Income tax board asking them to garnish his income tax for child support arrears…Send it to "Attention Tax Garnishment Division. In reality, he isn’t that far behind so the DA probably won’t file contempt charges (although you can) If you talk to the ex… DO NOT tell him you are filing contempt or going to the tax board!!! Never give them a heads up!!

He’s supposed to let the courts know that he has a job and needs to give proof of how much he makes so they know how much to take out.

The easiest way imo is to go through the OAG (Attorney General’s Office) closest to the county in which you reside… They’re usually pretty good about handling things as far as license suspensions, etc.

Unfortunately, there isn’t anything you can do to force his hand except hire an attorney. Usually they won’t take such a case unless he’s behind an exorbitant amount.

You need to contact them if you know - they’re supposed to know but sometimes they don’t.

Also, if he is in a position of authority like my ex was, he could take the document (requesting to know if he works there) the JFS sends him and throw it in the trash. This document never gets sent twice unless they have proof they need to. My ex was a supervisor and evaded child support by doing this. If you’re aiming to collect back child support/catch him on child support evasion, each state has different laws on that. For Ohio, it was 6 months continuous nonpayment. Which meant… he could make a payment every 6 months and stay out of jail. It’s stupid as hell. You’d need a lawyer. Odds are you’d pay for the lawyer about as much as you’re gonna get, but at least he’d get a reality check.

It usually takes about 2-3 months to see any money. Maybe longer since he’s inconsistent and behind. It takes 1 month for his ssn to trigger the system. A few weeks for the employer to respond with his info and deductions and a pay period from that point for it be be deducted, processed and sent to you. You can call them and tell them the company and hopefully that’ll speed it up since it’s a large business they can just call the corp and start the process sooner.

Work more than one job, find adequate daycare… That way you don’t ever have to rely on if you get child support or not… Just think of it as a bonus if you do get it! Then your child will know that he or she was raised by one bad bi$&@

Yes, let them know. I had to call them multiple times because they drag their feet. I think they got tired of hearing from me so they finally got the ball rolling.

I woke for DRO in my state. Sometimes it does take awhile for the attachment to become active. We’re also not allowed to give information out as far as telling the CP where money is coming from or where they’re working. We say between 4-6 weeks. I would give it a month or so and then call in and see if they can resend the attachment

Call court set up with them thrue domestics in your area

I live in mass and have been dealing with DOR for 9-10 years. The system randomly runs his Ss# but you’re best off calling DOR and letting them know he is working for BJ’s they can run his ss# manually and find out which location. DOR will send his employer the paperwork. They’ll have 30 days to start submitting payments. Good luck hope this helps!

In my state i go online to my states website for child support, sign in, and fill out as much info as possible on thr report new job and in about a month or 2 the state was withholding child support as I know he will never report his job.

I’m in NH and in the same boat with my ex. I usually call our caseworker for information or to give her information if I have any because I know he won’t. We have it set up he pays a certain amount and some of that amount goes to back support with the rest being a general support payment. But it’s up to the caseworker to get everything moving again when they have that info.

Depending on what state you’re in you can contact the child support enforcement and file criminal charges.

Call 6176262700 that’s department of revenue child support in Massachusetts. I am from Massachusetts and give them as much information you can and start a claim if it’s already court ordered then they have a case number you can get online and fill out forms

If he’s already in the enforcements database, all you can do is wait. Consider it a loss cause if you don’t get it and a lucky day if you do.

My first thought is this nurture the relationship. Involved fathers are more likely to pay child support. Why is it supervised by you? If he was good enough to have unprotected sex with then you knew the type of person he was and still chose to do that. Fathers are essential in childrens lives. Also visitation and child support are seperate issues.

It’s better if you can report his place of employment to the child support agency. No one steadily monitors cases

Usually their system does a random pull on dads ssn. So if you have new info just let them know and they’ll run his ssn.

Some times it will come as a lump sum when he files his taxes. I would still report it as he may be receiving cash rather than a paycheck where taxes come out of.

Contact the case manager and give them what info you do have. Idk what state you’re in but if he got any money back from taxes it shoulda been taken and given to you for child support, in most states anyway. Ask about what legal proceedings you can follow too and maybe see if you can take him back to court- or they can put out a warrant for failure to pay

As long as they have his social…and I’m sure BJ’s is not paying him off the books since those late companies get payroll audits quite often……he will show up as delinquent and the ball will start rolling.

You can always look into felony charges for non payment of child support by contacting the attorney general of your state. Currently in the middle of that with my ex however it is the state vs him. Doesn’t help with child support however it makes them accountable.

It’ll hit the system on its own if he’s actually working because they do income witholding by social security number. Call you case worker and see if your county doesn’t a show cause hearing but keep in mind he can just make a payment and go in there to get his back support put into smaller payments which will technically bring him current. The system will catch up with him at some point

Yes, if you have information let court or prosecutor or child support office know. It should expeditite you getting payments.

Good luck,. Ex dodges and moves anytime payment comes out… behind over 46,000 now kids are grown…got 2 payments couple months ago and then bam done again…LoL so he still hasn’t grown up… figured I will get it once he tries for social security…lol

My state allows the person a few weeks before they start taking payments out. You can’t expect them to not get on their feet or not be able to support them self too.

They can run him in the database to find out were he works. Let them know at least the company name. Keep doing show cause hearing and maybe try a lawyer?? Wish I could give you some better advice

I wish I had advise for you. Child support enforcement is a joke. Chances are either his mom is lying or he’s working under a different social security number. When they get behind they should sell all their belongings &, put them in work camps. Part of their check goes for room & board the rest towards child support until it’s paid (& it’s continuing to build while in this camp). They get no money or freedom until their child support is upto date. I bet NPCs would pay.

I was lucky I got 5 months of child support, But the courts can put a. order on his taxes, just so you will get some money from his tax returns.

Give it sometimes, they will start deducting it.

You should of gotten all of the Covid payments, if he got any. Someone is not doing there job, but you should of kept on top of it. I would get him back in court and let him spend some time in jail, maybe then he will work.

It took months for me to get child support from my daughters dad when he started working.

Why don’t you just offer to move in with them and see how that goes and take their son back to them.

If he gets pd cash or self employed good luck cause that becomes he pays when he pays. Hope he does taxes and gets a return that will pay you …

Call child support enforcement. Find out who your case worker is. Start calling this case worker at least once a month!!! If you got any or can get any info on him give all information you have on him to the case worker. Demand they take his taxes returns also. Sometimes you got to make people do their job. Sad, I know. If your case worker don’t seem to care ask to speak with her supervisor.

Your local child support office should be able to help you.

In Illinois it always seems to take a few months for them to catch on that the other parent is working if at all. I’ve always notified them of a new job to speed up the process. An idea for you to find out the exact location is to call all of them and act like you need to speak to him for something. They’ll either say he doesn’t work there, not working today, or attempt to go get him. Also once he files his taxes it will go straight to you.

Usually takes a little for them to find out he’s working and start deducting from his check. Here in MD the employer has to fill out paperwork stating he’s an employee, his hourly wage, ect

If you have new information like his working again you need to provide that to child support for them to investigate. They wouldnt know if he started work new or not unless tjete is a tip for them to follow. Once they find out they request it from employer. Your information is enough for them to investigate.

Also, let the IRS know there is case in force and get the info you need to have him put in the database as a deadbeat because you will also get his tax return refunds until he is caught up…

Laws changed during Obama’s administration. Good luck getting anything done without hiring a lawyer and taking it to court yourself. Which will cost you even more. My ex is over $20 grand behind and nothing is done. Who needs their money anyway? You’ve got the most important thing in the world, your children.

If your in MA you can file a contempt, they will order him to get a job, then suspend his license, jail time if you want to go that route, personally my oldest “sperm donor” was out of his life completely for 6 years never paid a dime I never bothered, but when he had the balls to take me to court he owed over 18,000 and well he ended up asking to sign over his rights and he’s signed the paper work and had it notarized right in the court house … oh and you can file contempt every 6 weeks of non payment …

If you are on any state assistances in food stamps, rent money ect medical…the state takes their cut of payment owed first as it would be equal to his pay or more. If Confused talk to your social services in your county or state so they can clarify it

You can apply thru the income support office in your city or child support office directly in person or online. I did it thru the courts my self which made him pay for the filing fee and other - testing for my case then.

You’d file for child support with your local child support agency. It can take some time for them to gather all needed information (your pay/other parents pay) so it definitely doesn’t happen overnight.

However, just as a forewarning, once you file for child support it may make the other party mad enough to file for more visitation time. Most paying parents file for 50/50 custody after one parent files for child support because it’ll lower/cancel out the child support payments. So I would definitely think long and hard about filing.

In Va we have DCSE-dept of child support enforcement and you can file on line and they will call you and they can help guide you on what to do next!

I went to my county DSS office. They also have a child support office in the same building. In some states you have to go after the absent parent for child support in order to get government assistance.

You file a motion. Make sure it’s the right one. One asks for exs signature due to them being in agreement. The other is one you sign yourself to get a hearing to force it. If paternity hasn’t been done you will have to put in a motion to establish paternity first.
