A friend of mine has a case against her that prevents her from working with children. At no fault to her. It was something her husband did to her while the child was home. Basically showed aggression and cops came. No charges were filed especially against her. But this prevents her from working with kids. She lives in NyC. Does anyone know how to clear her name so she can resume working.

Same thing happened to my mom n my dad didn’t even live with us he was harassing her n showing up to the house did cookies in front yard with his car n she no longer could do daycare, the system is screwed up.
There would have to be something criminal or w DFACS. I agree with consulting an attorney

It wouldn’t prevent her, or even him, working with kids if no charges were filed. I suspect some form of hearsay is preventing her from getting jobs if she’s trying to apply. This doesn’t make sense.

I feel like there is WAY more to this story than what is bein told. She should talk to someone in the legal field that can help her if it really is an innocent as you say it is. I’m having a hard time believing that she can’t work with kids for the reason you stated.

If the case was substantiated with DCS, then she would be placed on a state registry that prevents her from working with children. There is an appeal process that should have been mentioned in the letter she received with the finding of the child abuse case from DCS. A person can still be placed in a state registry preventing them from working with children without charges from police.

If she was never charged then it wouldn’t even show up on her record… It sounds like your friend is either lying to you either lying to you or is not telling you the whole story. There is absolutely no way she would be Prohibited from working with kids unless she did something abusive to a child

There’s way more to this story, if no charges were filed against anyone then there wouldn’t be a record of anything that would cause her to not be able to work with kids. And if she’s really a victim of a crime that also wouldn’t cause her to not be able to work with kids. Sounds like you don’t have the true story & you probably shouldn’t help her be able to work with kids, her name has to be listed for a reason.

Yea she’s definitely lying to you and not telling you the whole story. There’s wayyyyyy more to the story as to why she can’t work with children. If she never got charged then that would never be put on her file. Sounds like they did find her guilty and she got charged, so now it’s on her file.

I’ve seen moms lose their kids who won’t leave their abuser. Either it’s something like this or he harrassed her at work too. Or you’re not getting the whole story. Because if no charges were filed, there obviously wouldn’t be anything for her to clear from her name. Doesn’t make sense. There is an important detail someone is leaving out.

How does anyone know if no charges were filed? Something is missing from the story.
If you know we’re taken I would go get an open record request if you went to court and get the original police report I would investigate because this is too much missing like a lot of people said he could be lying to you

I have been in a similar situation. Wasnt charged and the incident occured when i wasnt home. But i still cant work with kids elderly etc cuz its on file with childline. You have to petition them to remove it. If u need more info message me please

Sounds like there is more to this story than you are telling us, or you know. If she legally cannot work with kids then charges have had to be filed. She would have to talk to a lawyer the lawyer would be able to help with that. However if it’s an active case I don’t think anything can be done until it’s over, but I am not 100% sure if it’s different in every state. Have her talk to a lawyer.

There’s way more to the story. If she had a case with dcfs and it was “founded” then she wouldn’t be able to work with kids. If she was “founded” then she can appeal it within so many days and if she cannot get someone to represent her she can represent herself! But there’s more to the story then she’s telling u…if the case is “unfounded” then it would not prevent her from working with kids

For everyone saying she’s lying , she probably isn’t. And stop judging, had this happen to me. My neighbor was supposed to watch my kids, she was at her house the entire time and my kids called the police. Police came to my job and my neighbor shows up after I had to get off of work to go to my house. She admitted she was supposed to be watching them but they still tried to charge me. Charges wee dropped but CPS still wrote a report I couldn’t combat in time and now it’s stuck on my record as well.

So it sounds like since cops came they ended up calling child protective services to get involved and due to the home environment she was founded of some type of child abuse like endangerment or neglect etc. so either your friend isn’t telling you she was founded of some type of child abuse or you already know and failed to mention that. Also if her husband shows aggression etc then her working with children could put those children at risk due to his aggression and no offense I wouldn’t want her near my child if I knew her husband could show up and start being aggressive because not only is it harmful but it’s traumatic for children

My aunt whipped my little brothers behind with a shoe and left marks. She plead not guilty and took it to trial. Because there where no evidence found (aside from the bruses ) the trail found her not guilty but she still cannot work with children. Once you are charged with child neglect endangerment or abuse dosen’t matter the end, you still will not be able to work with children
That doesn’t seem accurate. It wouldn’t go on her record if she wasn’t charged and sentenced by a judge

OP and the friend could be telling the truth. I know someone who was charged with something they didn’t do (I know for a fact they didn’t do it). The DA and the lawyer they PAID for and the judge all railroaded them (the person I know). The DA lost many cases before theirs and the DA got a lot of money for winning a case… The lawyer the person hired, turns out was a crappy lawyer who never really tried to defend anyone that hired him… Basically the lawyer was a dirtbag lawyer… They have been fighting everything to get their name cleared. They also recently found out they aren’t no longer allowed around children, even though the supposed crime wasn’t against a child.
I have a similarity experience. I worked two jobs 56+ hours a week, and my husband told me his mom was watching the kids. Well I found out he was leaving them with his niece who was 16 but I didn’t trust her, would have Never left them in her care. But I found out the hard way. As in she left to go to a party. My daughter had a febrile seizure. My 9 yr old called the emts. And they tried to charge Both my husband and I. And I was told after they took 3 months to investigate. That everything against me would be dropped. However when I applied to work this last yr in my daughters class. I was informed I had a child neglect mark on my record. And it was “too late to appeal,” and I had actually gone to school for child development and had previously worked for DHS/CPS as a peer mediator and a visitation monitor. So… I know the system can literally screw you over!

If it’s a mistamenoir charge go to your lawyer pay 500.00 he can get it off there …my brother in law just did this …plus a mistamenoir is not a bad charge you should be ok to get hired any where …good luck

If it’s on the caregiver background check then there’s nothing you can do. There were abuse/neglect/failure to protect claims that were substantiated.

Umm it doesn’t work that way. I am a teacher and in order to not be allowed to work wth children you have to be charged with something that’s on your record and be denied on a background check. Sounds like she’s not telling the full truth and just putting all the blame on him. But if cps was involved and they found her unfit she’ll have it on record and won’t be allowed to work with children. And personally if you weren’t able to stop what was happening at home you shouldn’t work with children because if you can’t keep your own child safe how are you going to keep children who aren’t yours safe?

You are missing a big chunk of the story because unless charges are filed then there isn’t a case. If this is an active investigation with pending charges, then it’s understandable. I’d ask your friend to be a little more honest with the actual situation is.

When you have something on your background check that can prevent you from working with children, you can contact your local department of children, youth, and families services and contest what flagged your background check. You will plead your case and then they will make a decision on whether you are fit to work with children. Every state is different, so you will need to make sure you are contacting the correct agency. In Washington state, the background checks are processed through a program called “merit”. If you apply somewhere in childcare and your background check is flagged, the employer should know the proper steps to contest the decision. I have had to do this before with an employee as the director of a childcare facility.

If she can’t work with children that means whatever happened that night or any night is on her background … she can try and get it expunged… clearly she was at fault or is innocent but someone proved/found her guilty

It sounds like the child was removed by from her for her failing to protect her own child. This can happen to any mother. If the father, even her ex, or another person harms their child & she has knowledge but not the power to stop it the child can be removed & it’ll be put on her record as neglect. She needs a lawyer to fight it.

I used to work at a daycare and when my ex put his hands on me while I was holding my daughter and hit her while trying to get to me CPS got involved and I was not allowed to work at my job until the CPS case was closed because I was in an active investigation even though it was no fault of my own… so if it’s because CPS is actively investigating it or actively involved there’s nothing that can be done until it’s closed
