Question moms I lost my job back in July I had to keep putting my vehicle in the garage every 2 weeks and couldn’t afford doing that or the payments anymore so I told the bank to take it and I got home today and they are taking me to court for what I owe does anybody know what could happen
They will make a judgement against you to pay the balance after it is sold
You’ll get a judgement against you for the amount you owe. They might offer some kind of payment plan but if you don’t respond, they can eventually garnish your pay checks or taxes so don’t ignore it.
You will agree or disagree agree that you owe the money. The judge will probably see what you can pay on it and will probably set up a payment plan and if you don’t pay you will be in contempt . You might be able to actually stop the whole court thing if you call and see if you can work out a new payment plan and they will probably have you sign something.
Get proof of what they sold it for the current resale value and what you owed when they picked it up, proof of any repairs take to court with you and explain why things happened and see if the judge will give you any credits…if pictures of condition of car take those to. So if they under sold the car or jacked your remaining balance they can adjust it.
I went through this last year. They gave me and my ex husband 2 choices,pay the car in full, or pay half of what was left plus their court fees and taxes.
They can garnish your pay till the car is paid off
If they have already taken possession of the vehicle and sold or junked it (if it had that many issues it’s possible they totaled it out) they will take it to court for a judgement. You will likely still owe the difference between what they got out of the vehicle and the balance of the loan. You will have a chance to speak your side but likely will go in favor of bank and you’ll have to set up a payment plan or they can garnish you once back to work.
File bankruptcy and they can’t do anything…
