My maternity leave was denied

My maternity leave request was denied. I will have completed 10 months of service when my baby is born, falling short of the 12-month requirement. My position cannot be guaranteed and will be open for recruitment. I had assumed that we had more rights than this.

You should’ve researched that. FMLA requires you to have at least 12 months on the job. Oh well.

You have the right to have a baby whenever you want but you can’t expect them to take care of you for free. You were irresponsible in your decision making there’s consequences behind that.

This country sucks at supporting moms postpartum. There are thankfully several work from home opportunities you can look into! My family members work for AMC Health, try there for a start! You got this mama, I’m so sorry there are rude comments already and even worse support from the country you pay taxes too to receive support when you need it. I also was two months short of my FMLA, and was replaced when I had my daughter two years ago. I did substitute teaching to be able to bring in an income without the full time schedule. Depends on what state you live in but some states require a minimum 6 week leave by employers

US Parental leave is a joke. Unfortunately to qualify for FMLA, you need to be at that job for a full year or a certain number of hours. Your workplace is within their rights.

Talk with your employer and ask them if they are going to keep you. If not, apply for unemployment.

It’s not about the leave itself it’s about the fact you haven’t been there for a year. This is common.

Rules are rules. Don’t like it then stay home :woman_shrugging: they should of went over this before they hired you not there job to support you just because you are having a child. Should of thought of all of this before you got pregnant so no one owes you anything

Yeah it depends on what state you live. Certain states and medical doctors can put you on disability and it would cover you. But then other states don’t do that or have different policies/procedures/laws.

You could try unemployment while on maternity leave, but unfortunately your best bet will be to either reapply when the baby is old enough for child care or find a new job… I had a job when I found out I was pregnant and they and I would have been there a year and some change at the point of mat leave, but they started to get shady when they found out kept trying to get me to go part time it was ridiculous. So I quit, found an amazing job with amazing people, they didn’t know I was pregnant when I started, but they weren’t mad and offered me 13 weeks leave. It was unpaid but my job was going to be there for me after. It was amazing, sometimes you just have to find a better place to work that’s more understanding.

No unfortunately they don’t care about mamas in the job Force. I worked at a Chevrolet Cadillac dealership when I was pregnant with my first child. I was an auto detailer and customer service representative for the company. I washed over 50 customer cars a day I also did detail work in the detail shop and then I did filing for them also and drove the shuttle back and forth to pick up customers from their homes to take them to the dealership and so on I also ran parts. I worked my butt off my first review my boss thought it was so great he was going to give me a 10 cent raise🙄 disgusting. A few months later I got pregnant and I worked until I was almost 7 and 1/2 months pregnant and then I couldn’t fit in between the steering wheels and the seat anymore to vacuum they told me they were going to give me a different job to do until I could leave for maternity but that never happened so I ended up having to go on maternity leave early. During that they decided that it would be a good idea to fire me. So I went to the unemployment office to get my money and they tried to deny me saying that they tried to give me other jobs but I just denied it which was 110 percent untrue. I begged them for other work I needed the money for my new baby and new house we just bought. I got my unemployment. Because lithia of twin falls decided they didn’t want to get sued. but yes they don’t give a shit if you’re pregnant they’ll replace you in a heartbeat always remember in a job you never matter you’re always replaceable. It sucks but it’s true. I worked there for 4 years too it wasn’t like I just started. It’s hard being a woman sometimes.

Are you eligible for short-term disability? Might help. It’s not 100% of your salary but it’s something. But you still may hit that 1-year requirement. I’m sorry. The U.S. has the worst healthcare and maternal care system in the developed world and too many are pro-birth without being pro-life, and women still have to deal with so much discrimination in all aspects of our lives.

Check with a lawyer; it may be illegal to fire you solely because you’re pregnant or have given birth.

If you have more children, if possible plan them carefully around your employer’s policies. Or move to Europe where it’s so much more humane.

Sorry your being done like that. I worked at a nursing home when I got pregnant with my twins I was a high risk pregnancy. My Dr put me on light duty nothing heavier than a gallon of milk. I told the nursing home and we sat down and talked. They helped me use my benefits to continue getting a check until I had my twins. When I was able to return to work the girl I had babysitting didn’t work out. I called work told them they said bring them with you we got this until their dad can get them. They were great and understanding. My babies got to cheer up the elderly people while I was working. All the elderly people would talk about was thoss cure babies that came to see them.

I don’t see how they can deny your leave. A good doctor isn’t going to sign off and let you go back to work right after having a baby. At least none of the doctors where I live would. Anything could happen during childbirth.

No and it’s usually company policy that u be at a company 12 months to be approved for any leave of absence

I had enough time and even was able to file for fmla but because when I left i worked 3rd shift that’s all they would take me back under… with a newborn and a husband who worked days… so they forced me to quit

That’s really unfortunate. I was also 2 months shy of my 12 months so I didn’t get FMLA. But the company did approve 6-8 weeks off unpaid, and I could use my vacation/sick time. I’m so sorry to hear this. You’d think they would have some kind of compassion, especially for hard workers.

Not enough time served to be eligible. Resign in good standing and reapply. If you were a good employee you should be rehired.

Never assume anything!!! listen and read all the papers u are given and made to fill out ask questions. Its is not the company’s responsibility to make sure you know your rights….its yours! further more did ur company get a say in weather or not you got prego? No….so why do u get a say in how they deal with it? There were parameters around pregnancies you didn’t follow them or meet the criteria. It sucks a lot!! As inconvenient as it is for you to lose your job it’s just as inconvenient for them to have to replace you because of your life choices. I’m sorry momma this is tough lesson to learn! I hope you’ve learned it and don’t make the same mistakes next time!!

I only got to take 3 1/2 weeks off then I had to go back to work lol … I did not get paid for time off but I did still have my job. Our country isn’t like others in that category… they don’t care about our health here .

There’s a bill proposed to lower the 12 month requirement for FMLA. Might keep an eye on it

I never had maternity leave as a dental hygienist I always had to find another job. But I worked for my daughter in law when she had the grandkids so she could keep her job!

What about short term disability?
