Any mamas here ever had to mail in your tax return? Long story short, my kids “dad” claimed them on his taxes so mine were rejected. I know I need proof they were living with me the full year. What else would I need other than the printed tax return itself? Never had to mail in before, always e-filed mine.
Check with the IRS!!!
Are they in school? Get a letter from school stating they were enrolled and dates
Statement from their pediatrician that has your address or if they are school aged then demographic info sheet from the office with the school year and your address
Copy of your lease agreement if you’re renting/leasing. Letter from school with their dates of enrollment if they’re school-aged.
If it’s canada? Report cards, dentist bill, any activities,
Happened to me my lawyer had the judge write a letter and I sent in a cop of our divorce decree.
You will need a copy of your lease, school records, any court documents you have as to who they actually lived with more than 6 months out of the year. If you cannot provide that then you wont get to file them and reverse what he has done. It will take a long while to straighten that out even with paperwork. Good luck.
School records medical records proof of address birth certificate socials I used my back statements and bill statements. I take pictures of my receipts to earn points back for gift cards that proved I provided all year long when I had to mail in proof.
Custody papers, school records, Dr statements. Last year tax returns that show you claimed your children. Submit with your taxes. IRS will review and you will be good to go.
2 sources such as Dr, school, counselor, etc stating child lived with you.
Get a CPA to handle it for you
All your W2s and any other sources of income that you’re filing on. You can send in proof the child lived with you and the custody arrangement at this time, but be prepared to show them copies again of proof it’s your right to claim your child down the road. You’ll get your refund now, but down the road they’ll send out a letter to both of you, and knowing the IRS, they’ll ask for it again. If you have all that proof including a legal custody arrangement, and he doesn’t have a form 8332 showing he can claim the child, he’ll (assuming it’s the father} have to pay that part back with penalties and interest. But get that in quick and don’t assume you don’t have to send it in again if you’ve already done so. Do it again.
Custody papers, school documents, medical documents, things with your address
When I dealt with a complicated tax situation due to child custody a couple of years ago the IRS told me do not send anything with my tax return or it would be rejected. When they ask for evidence you only send what they ask for, and you have to send it to whichever department they tell you to address it to. You won’t just send the evidence to the IRS in general it will have to be addressed a specific way. If you send it to the wrong department they won’t transfer it, you will have to resend it. That’s what they told me.
They had me mail my return and then they asked for my court order so I sent that in. They didn’t ask for anything else.
First off, do you have a court order for custody, child support, who claims them, and which one of you received the stimulus payments, if no court order, your screwed this year, file for custody, child support…etc…there are places that will file your taxes for free, check for info in your area…if you make less than 50,000 a year.
Does your parenting plan say you claim them? If so, just send a copy of that in with your tax forms.
You need your divorce papers that show who gets to claim the kids . For example , it was stated in my divorce papers who claimed the child and on even or odd years . So , there was never an issue
The bigger question is do you have a divorce decree stating who claims the child each year?! If so, no evidence will matter because there is a court order in place to share the child on taxes (ex. Every other year).
I would get a lawyer and go to court and make him pay it all back
Amy thing that can prove that they have been in your custody and control for the year.
You just mail in your taxes amd then when its processed the IRS will request documentation. If you mail it with your taxes , you’ll just have to mail the proof again when they request it. Also, they dont accept divorce papers as proof to claim (in reference to above comment) its literally on the IRS website that they dont accept divorce decrees. Tax law superceeds divorce decrees
I would call the IRS and asked them what they want. Its your safest bet
My ex did this two years in a row. I send in the paper return and the custody and support orders. If they request additional documentation, send them again. In my case he has her every other weekend and doesn’t take her. So it’s a given who is eligible to claim her.
