What should I do?

Looking for advice on divorce. We are Georgia residents however we have been living in Florida for the past four years. We kept GA ID because the car insurance is much cheaper than Florida. We have two kids. If anyone have any info regarding divorce laws for GA and FL I’d appreciate it. Would it be better if I move my residency to FL and file here? I’m trying to get all info and my ducks in a row before I head to a lawyer. Thank you.

You’re legally required to change your residency if not military like 30 days after you initially move. So I would start there

You are not Georgia residents if you’ve been living in FL. When you file, you have to file where you’re living.

Now I very well could be wrong but isn’t insurance based on where the vehicle is parked? I understand what you told them, I’m just concerned if they find out the truth. That would put you in a position, if something happened, for you to have to walk a very thin line. Too thin for me. I would start with all the address changes.

Legally you are FL residents as you’ve resided there for whatever length of time they use to determine residency for legal purposes, usually 6 months to a year. Since you’ve lived there for 4 years then you’ve definitely met the time length requirement. It’s also a crime, a felony if I’m not mistaken, to lie about your residency to get cheaper car insurance. That’s actually a really big deal and you can get charged with fraud, pay fines, and could easily be barred from getting insurance if companies knew. But anyways, you need to file your divorce in FL. FL has jurisdiction. Whoever is the petitioner will file in the county you’ve lived in for the past 6 months. GA has no jurisdiction over the parties or children and can’t hear the case.

You aren’t a resident of Georgia anymore. You will have to file in Florida.

Legally you are FL residents. Regardless of your id. If you get pulled over, you’d get a ticket for your ID being wrong after 4yrs.
To file in GA, you’d have to be there.
May as well file in FL to keep it cheaper and simple.

You’ll definitely need to come up with a reason why you didn’t change over residency because that’s trouble for you just waiting to happen. Perhaps saying you’re back and forth from each place atleast 5/6 times a year maybe more…But you better come up with something good😬

You probably shouldn’t post the fact that you’ve been breaking the law for 4 years, if your in an accident, you have no valid driver’s license, no valid insurance…plus that’s fraud against your insurance company…do the right thing…

So legally you are Florida residents, and you will have a lot of problems with this, it’s illegal to have not changed your residentcy after a year
