Will an arrest show on a background check?

Yes it does if the trial is still pending. I got arrested on a trespassing charge that the state dropped but between the arrest and the trial, it was on my record

Tell the job what happened before they run the check. Usually if it was years ago, or as long as you didn’t get convicted or do time, they won’t care. They tend to look past misdemeanors and look for worser things like felony’s or anything bad to do with children, or thefts because they want to be able to trust you working there. You might not be at the top of the to-hire list if you have a assault misdemeanor, but usually you’re still a hire-able candidate.

Read the paperwork you got when you went to court from your sentence date if it went that far. If its a felony then yes it will show up. Most places if you tell them about it and its over so many years then they usually will hire. But it all depends on the place

So it’s not just arrest then. It’s arrest, charge, prosecution and time. But more than just arrest. Of course a prison sentence will show and so it should especially for assault.

Depends on where you live . I applied for a job and a domestic violence charge (no children involved) came up on backgroung search after 25 YEARS!!!

In Florida they don’t even need to do a background check. Mugshots are public record. I can google someone’s name and see their mugshot and charges. Be upfront and honest before they look you up.

Arrests will show up. Over 20 years ago I was arrested for assault and battery, long story but my cousin’s MIL kidnapped her son for a week and we got him back. A background check was ran years later for me to get my concealed carry permit and I was denied due to this arrest, even though the charges were dropped, the arrest still showed up. I had to get a copy of the charges being dropped to provide to SLED so my permit ended up being approved. If you were not convicted call the county and ask what needs to be done to show you were not found guilty, be honest with your potential employer and show them the charges were dropped/you were found innocent. If you get ahead of this from the beginning your potential employer will probably respect you more for being honest.

I do believe charges show up on a background check. I would be transparent about it during the interview and just explain what happened.

If they do a background check, yes. But if your honest with them and explain what happened. They normally don’t care. I have a trespassing charge on my record. (Long story) & applied at a nursing home. They still hired me cause I explained the situation of what actually happened and it wasn’t anything bad. They’re typically pretty understanding if your honest with them.

If it’s a felony it will. I’d bring it up as a matter of fact. They’re gonna find out either way.

If you were charged with assault it will show up. But if you got arrested and no charges pressed then it usually doesn’t show up.

it depends on the job, if you’re convicted etc. Most of the time on applications it only asks for convictions but they might pull arrests too. I wouldn’t let it keep you from applying.

First, as an attorney who formerly did criminal law I can tell you that the laws on these issues vary greatly from state to state, as well as federal and tribal laws. Anyone telling anyone on here what “the law” says is doing everyone else a disservice because what the law is where you live or what you think the law is where you live may not apply to this person. Second, laws change all the time and if you don’t practice in that legal area in that jurisdiction then you probably aren’t up to date on what is currently accurate. Third, every jurisdiction within each state (city, county) is also unique and what some prosecutors and judges will do others will not.

You need to talk to an attorney. Many offer free consultation where they explain how and if they can help you. Talk to an attorney. It’s worth it. This is a big deal and you shouldn’t rely on the internet for your answer. You may be able to apply for expungement and have the arrest removed from your record. You may or may not need an attorney to do that. Depends on where you are.

Only way to know? Talk to an attorney. A REPUTABLE attorney. Remember that with legal work you get what you pay for. If you have a law school near you they may offer clinics where law students train and can provide you with information at low cost. Legal aid. Your local legal bar association. All good starting places.

If they ask on the application or interview, or anytime really, tell them. Don’t hide anything. Honesty truly is best. There are plenty of places that hire all kinds!

As long as you admit to it during the interview you will be fine . Most jobs are only concerned if you have harmed a vulnerable person/child or have theft changes . You can pay to have these removed from your check but it is very costly .

If you got a court case or case number through the courts whether dismissed or not, yes, it will show up. If you were arrested and no charges resulted (no court case) the arrest would not show.

If you were convicted like found guilty or plead guilty yes it will. Most places won’t deny just based on that conviction tho. If it’s a misdemeanor you may even be able to get it expunged. A lot of places are felony friendly anyways if it is a felony.

Yes it will even if you weren’t convicted. You can however try to have your record sealed then it won’t show up in most background checks. It still would for like the police and government jobs. I would ask a criminal lawyer about it, as not all records can be sealed.

All you can do is try! Different employers require/ look at different things. Just be transparent and tell them what happened. You can find a job :raised_hands:t3:

Be upfront about it especially if you know they will be doing a check. Better to get in front of it in case they have any questions. Honesty is best!!

Did you ever go to court? I’m assuming you did since you went to jail. It will show up, but then there should be an outcome listed —- convicted, dismissed, etc.

Just be honest with your employer. If it was a non conviction you shouldn’t have to list it.

do a background check on yourself. you’ll see exactly what’s in it. I needed to get my own to work with children.

If they do a. Background check yes it will come up. However, be straight forward in the interview that you were arrested in the past even ask if that will be an issue regarding employment. They may ask you what the arrest was for. Be honest. If they don’t hire you then or say yes it will be an issue then the jobs not right for you. But be honest. I know many who got fired for lying about their background. You will do fine.

Working in childcare it might stop you but working at Walmart it might not.

I work in the industry, depending on where the offense occurred it very likely could show up. There are only a handful of states that do not provide “arrest only” records to the public.

It could show up but will show not guilty or what if the plea was for a lesser charge. On the application does it say were you ever arrested for a crime or were you ever convicted of a crime?

Why does everyone find that so weird and unbelievable that they tried to assault OP yet OP went to jail? Have yall not dealt with cops? If they assailants all bitched out and lied and made up a story then it would be their word against OPs. Happens all the time.

I was arrested for a felony and still have not had a court date. I was told only convictions show, but it was on my background 2 months later. So it shows I have a felony when I haven’t even had my day in trial. I was denied for several jobs because of this. But all charges are different and it depends highly on what field you’re going into. Anything involving violence or money are typically the ones they don’t look past.

If you’re in PA I can look and tell you right now. If you’re in a different state it may differ from state to state. If you have your paperwork it will tell you if it was a misdemeanor charge that you were convicted of then you can consult an attorney. Sometimes you can get it expunged from your record. Depending on the amount of time that has passed. More than likely the charges will show up if you were convicted.

Yes it will show. But…how long ago was that? If it has been 3-5 yrs ago it shouldn’t be a problem if it was a felony. I recommend be honest with the employer.

Yes. But once your case has been closed for a certain amount of time you can have it expunged/forgiven. I’m not sure of the process and you’d have to check with your area on the amount of time/process/cost. I had a cousin who had an assault with weapon charge and got it taken off her record after going thru the process for a job and got the job. This was in Tennessee…

How she can she not be convicted but go to jail? She’s obviously been convicted, she’s gone to prison. It will show up if they run checks, in the UK its called a CBR check. After so many years you don’t have to declare some things though.

It just depends bc I went to jail for a misdemeanor and was on probation and all that but it never once showed up on any type of background check I’ve ever had ran.

Yes it shows up on background checks. Its never interfered with getting a job. But has definitely interfered with finding a house.

Yes it will show up on a background check. Depending in the job there really only concerned if u got convicted. And we are able to look back to your 18th birthday. It all depends how far back ur job wants to go. I did background checks.

You can look yourself . Use search bar on internet Go to whatever county and put “circuit clerk” you can view everything from traffic to felony on anyone (example; St. clair county circuit clerk)

Yes, even if someone calls and complains about you it’s on your record (I learned this recently because of a family member using my name, they didn’t get in trouble but still :rage:) they all show up but it really depends on what the person or company doing the check cares about… like are you a convicted felon? That’s what most places care about… I only learned this when my landlord did a background check on me and was like so you had a call/ complaint on such and such date( which btw was like 3 years prior in a town I didn’t even live in​:roll_eyes:) turned out it was a certain family member, no charges where made tho, just the call :woman_shrugging:t2: no place has cared to even mention it before and , they only asked because they wanted to make me aware because they did not think I had ever lived in that town… It’s a pain in the ass to get off there too or just wait however many years…

Yes it will show up. But for something like that it is best to be honest with the employer. Did they tell you that you could get it exponged after x amount of time? Many judges allow that for first offense misdemeanor.

Just apply. Stop being scared, that’s just an excuse. It will depend on the type of job you are applying for and what you’re qualified to do. If it wasn’t a conviction they will most likely just ask what the situation was.

Cops today are unbelievable! My friend, director of Nursing, spends her days saving lives, husband assaulted her. Police came, arrested her instead. Ofcourse all charges were drop but thats not the point. These cops need to understand they swore to serve a d protect. She ask, “why are you arresting me, I was the one assulted”. Cops said, we need to arrest someone. That was it!

It depends. I’m some states, if it’s just a normal public background check only convictions will show up. But if it’s for working with children or law enforcement or anything outside the realm of “normal” a lot more will show up, including arrests you haven’t been convicted of yet.

Arrests show up if you were charged, regardless if you have gone to court or not. Some states don’t release arrests only and some states do. Also depends on if it is in the courts system or not.

An arrest history and charges/convictions are two different things. But court records if publicly accessible can always be searched and that will show arrests with charges.

Most employers are concerned with felonies. Some do look at misdemeanors, but depending on the charge, they don’t worry about it. Just be honest with them, most do give you a chance to explain it. I have a misdemeanor on my record for the same type of charge and it hasn’t stopped anything. I just got hired at Blue Cross Blue Shield of Kansas City.

Depends on the job an the type of backround check. I worked with vulnerable people an had extended check done by an employer - it showed every single interaction with the police. I lost out on a job because an ex boyfrirndd new gf called the police on me saying i was harassing her… after showng the police my phone an the multiple harassing msgs from her an none from me they she was given a warning.

I got jumped by 2 girls and beat the shit out of them when I was 19 or 20 but police see it as self defence and it didn’t go on record if it was realy self defence don’t think it would show on record I didn’t get arrested tho police just come to my home and asked questions… I did a cb check for working in a school got the placement and all was fine because I’ve never been in trouble and that wasn’t my fault

Once you go to court and you plead your case it’s going to get dropped. Just from what little detail you provided if it was self-defense it’s probably not going to go to court

Where I live if your under 18 and it wasn’t serious, your criminal record just wiped clean. Anything after 18 is for life on your criminal record. This is for Canada
