Can you be evicted for being a sex offender?

Yes you can be evicted especially if where you live is near kids. Land lords are also responsible for other clients/tenants and need to make sure everyone is safe. Also if. You tried to hide that information when applying and they ‘found out’ then yes, they can evict you as it is a breech of contract.

yes if you do not disclose that you are on the sex offender registry whenever you moved in and if there are children in the vicinity they have every right to evict you. I don’t condone registered sex offenders. I don’t feel sorry for. I think they belong beneath a jail.

You get protection in jail and the Government helps you hide stay away from kids ya grubs

First, your paperwork from the court should have your terms and conditions as to what you can and cannot do which includes where and what you can and cannot live near or buy (and yes there can be special circumstances) 2) yes…a landlord can basically revoke ANYONES lease AT ANY TIME if they have justification (they have warned you about your dog barking excessively, you were required to list any felonies, etc) read your lease and maybe find legal assistance. There are a lot of them that will offer free legal advise and
3) shame on ALL OF YOU for land blasting someone when you dont know ALL the facts. There are MANY MANY reasons that the court can label someone as sex offender when they actually did ABSOLUTELY Nothing to a child. For example, urinating outdoors (if someone sees you and doesn’t like it and calls the police (I have witnessed many people urinating in a supposedly secluded place while hiking because if all the water you drink while hiking (when you gotta go you gotta go), back in the day we used to “moon” our friends (same thing applies all it takes is some uptight person to call the police and the state files charges because you upset someone 3) your 16-17 year old high school daughter is dating someone who maybe is a senior and has turned 18 they have had sex and your pissed about it and call the police, guess what you have now ruined that young man’s life for the rest of his life because now he is charged as a sex offender.
Don’t get me wrong, I am not defending anyone, if you do the crime you do the time, but NOT EVERYONE deserves to go to jail and has every right to get on with their lives, go to therapy (which is generally required), follows their terms and conditions. So yes…shame on you!!!

You can become a sex offender for having sex with another adult in a car,peeing in public, sunbathing topless ect; so maybe if it’s something stupid you can talk to your landlord about it. If it’s from something serious you should’ve talked to them before you moved in.

The question id ask is why are u on it cause cause u can be put on it for running around outside ur own home naked

Who in their right mind would have the balls to post something like this on a parent’s page. Maybe we are all getting ahead of ourselves, but when I think sex offender- my mind absolutely jumps to the worst. If you’re a mom with children, and are dating a sex offender you should really think twice. Offenders have certain standards that they must live by, so if (you or they) can’t be around children or live near a school, they have every right to evict you. Not every offender has the same stipulations. It depends on the extent of the crime. Please do us all a favor and delete this post

My advice would be to contact an attorney in your state who handles tenants’ rights. I’m going to assume that the majority commenting here, while mostly well intended, are not fluent in Arkansas tenant law.

If a landlord or property owner leases to an individual knowing about the record, unless the individual does something to break the rules, no the lease cannot be broken for that reason. Living near schools or a daycare is not automatically denied.

All these people assuming this person touched a child or raped someone but you can legit get on the sex offenders list from sexting and sending nude photos as a teen if the other parents report it :woman_facepalming:t5: there’s other ways to be on this list I’ve seen it happen

As long as your not living near a school. If you haven’t broken rent agreement then everything should be fine

Yep and it doesn’t matter why you’re on the list. You could have been caught peeing in public and they won’t care.

If it is a dumb charge like that you should go talk to them. Some people will look the other way if it was dumb. If it’s something else and you’ve done something dangerous this is one of the many consequences you have to deal with.

I hope you’re on there for something dumb though.

In California I work for government housing and we can evict for that reason. It is in our rules and regulations that we cannot house sex offenders or violent offenders. If you are receiving any kind of rent subsidy that could be a reason as well. This is something I would take up with fair housing commission in your state. They are free lawyers that represent the renters if any community. Hope that helps

That is why we do background checks before rent out. No sex offenders,violent crimes,or drug charges or denied right off the bat. Where we live,they post a billboard with pics and descriptions of every sex offender in the area so people know who you are. Hopefully you are talking about a minor offense. If a child or young lady was involved…hope you end up getting what you deserve from the surrounding public since didnt get it when incarcerated.

If it wasn’t disclosed prior to leasing, absolutely!

Well what people don’t always understand about the registry is you can be put on there for just about anything if your in the right county. Yes there are many that do deserve to be on there. Also depends on how long on the registry you have to be. You know not everyone is a lifer on the registry. Many have to complete rigorous classes, many polygraphs, tests, counseling… I would talk to an attorney

Talk to a lawyer. If the neighbour hood has small kids or teen girls/boys ( whatever the reason they’re on said list, I wouldn’t want the person around anyone they could be a threat to ) I wouldn’t want them there either. My personal opinion, anyways. But unless you tell them what you were charged with, they can’t really make a proper decision… could be peeing in public near a school or something stupid that got you on that list. But if it’s something to do with kids, teens or rape - you get what you get.

If the person lives near a school or where children go then yes. I mean to be honest if I was a landlord, I’d never rent to a sex offender. Don’t really care if it’s “discrimination”. I just wanted to say that yes pedophiles are absolutely disgusting and deserve every single obstacle they face, not everyone on the registry is a pedophile. One of my best guy friends growing up met a girl at a party. I was there when they met. We were 18, she was supposedly 17. Turns out she was really 15 and her parents pressed charges so now he has to register. It has affected his life greatly. It says what the offense was on the registry so I always pay close attention to that. There’s a big difference between a 30 year old raping/molesting a 15 year old and two actual teenagers having a relationship :100:

If you disclosed it before you signed the lease & they still let you move in then you could maybe fight it but if you didn’t tell them & they found out then no. It’s up the the Leaser in the end

I’m not defending them but we have no idea why they had to register.

Anyway, I would assume if you didn’t provide this bit of information when you first applied and the landlord found out and he doesn’t want a registered sex offender as his tenant, then yes? I don’t know though, that’s just my assumption.

sex offenders aren’t just pedophiles… there’s a lot of other reasons someone can be on the sex offense registry such as getting publicly caught having sex or public urination etc. can all get you on that list…it’s not just for pedophiles so i would say they should do extensive research on your background info to see if it’s something they can do, if it was something minor such as what i stated no one should be thrown out of their residence for that.

My soon to be ex husband didn’t do what he was charged with and is now a sex offender. Don’t be so quick to judge cuz u can be put on the sex offender list for peeing outside. But yes u can be evicted for being a sex offender of it states that sex offenders are not allowed to live there

While pedophiles are disgusting and deserve everything coming to them I do have a story about a situation that could’ve gone horribly wrong really fast had I not stepped in. I used to run a gym with tanning beds. This girl came in once that I could’ve sworn was in her 20s. She looked older than me, and I was 17 or 18 at the time. She had an older woman with her who turned out to be her mother because this girl was actually 15 and couldn’t tan legally without her mother’s signature. This 15 year old came back the next day by herself dressed to the nines with makeup on, high heels, and walked into the gym which I thought was weird, but I was working, so I couldn’t see what she was doing. I walked to the bathroom and noticed she was chatting up the men in the gym being very touchy and flirty with them. All of them were in their 30s and 40s. They were of course loving it thinking she was at least 20 like I did. I called the guys over as smoothly as I could acting like I got some new product in, and I told them how old she was. They were absolutely DISGUSTED. They couldn’t believe it. It just goes to show how fast something can happen. I also saw the same 15 year old that weekend at a bar. I told her I knew how old she was and that I would let the bartender and security know if I caught her drinking or talking to any older guys.

Sex offenders aren’t just ones who touch children or older kids. Some people can wee on the side of road or alley or which ever and be charged… I can’t stand people who touch babies or kids… I have no remorse for them. But I’m just voicing my opinion.

Those types of things are supposed to be discussed whether it happened before you moved in or while you lived there it is supposed to be brought up to your landlord. If you kept it a secret than absolutely. But it also depends on your offense and if there’s children in the building. I’d sign tgat petition.

Reading comments most of you are pretty clueless how this works. You do realize you could end up being on the sex offenders registry for BS reasons? Depending on state… say someone was 17 dating 15 year old then that person turns 18… Bam can get in trouble if parents wanna be dicks. Or…. 17 year old girl lies about her age tricks guy into being with her who’s older … yeah nowadays men ya better check ID :woman_facepalming:t2: and worst yet…. My 16 year old daughter (at time) almost ended up on one because she and 3 other girls were accused of poking a trans girl in the butt and hitting her! It was all a big lie…she was their close friend and use to cut HERSELF… her mother found the cuts and she was scared to tell her so she lied and said these girls did it and her mom pressed charges! We went thru weeks of court and my daughter spent a weekend in juvy!! These girls all cut school together helping this confused girl meet another girl she liked … they were all throwing little pebbles at each other putting them down each other’s shirts … it’s on camera in front of the school… they were friends and because of one girls lie 3 others almost had their lives ruined. Our lawyer said if we didn’t say guilty to bullying there was a chance they’d win and the girls could end up on a sex offenders registry!! We took the blame for bullying and all the girls were on house arrest with ankle monitors for an entire summer. That girl tried apologizing and being their friend months later and I told my daughter to stay the hell away from her. You just never know the lies and reason someone is on it… I think that whole list needs to be changed. They should have a pedophile list because there are straight up sickos that touch children and they should never be let out in my opinion.

There are a lot of factors that go into it. Was it disclosed before you moved in, is it by a “safe” zone, where is the house located, when did the incident happen? Most landlords I know do a background check even a simple one so if they didn’t do that and didn’t ask about any felonies/records then that’s their fault. It just all depends on the situation. Plus the state laws on eviction rules.

Im just here to say that its not always a sexual act that get people on the offenders list. Some people were peeing in public. Someone i know sent pictures to her boyfriend when they were 1y and got in trouble for distribution of child porn because his mom called the cops. Odk what this person got in trouble for but it isnt always for a sexual act and not always towards a child either.

There are so many unanswered questions. Did the person disclose to the landlord? Are they current on their registry and probation? Do they live near a school and or other tenants with children that predate them moving in? The mere fact that the OP states “sole” reason for eviction is the sex offender shoots a star cluster off in my brain that alerts to at least omitted information. I’m not making accusations of inappropriate behavior or in anyway suggesting the person has reoffend just putting that out there. I do however have a feeling a lot of information is missing here.

If there are children close by, then I think the sex offender should be. Children ALWAYS should take priority over a sex offender. Not even sorry.

Pretty sure you have to disclose those things when signing the lease. If you did and they accepted you as a tenant, I would consult a lawyer

But it will show up on a background check (if the place did one) every place I lived did background checks.

I live in Arkansas. It has the worst tenant rights in the country. Literally you have almost no rights as a tenant. The landlord can literally evict you just because they don’t like you. So they could definitely evict easily. It could be brought to court but the judge always sides with the landlord

You all know women can be on it, too. For all we know, the person got caught peeing in public.

Did they notify the owner they are on the registry? That’s usually required.

Also if you get caught peeing in public you get registered as a sex offender so I wouldn’t be too quick to judge🤷🏼‍♀️

Was background check done before moving in? If so, then I would think you have a law suit, if not, then they have a right to evict.

Guys you do realize that there are other reasons for people being a sex offender, other than being pedophiles and r@pists, right? People going to the bathroom on nature walks when there is no bathroom can just as easily become a sex offender.

What was this not checked out beforehand. Thats kind of alarming.

You dont have a leg to stand on as far as saving yourself from an eviction. Just because you pay rent and keep your apartment clean doesnt mean you should be allowed there. Ugh

Every lease I have ever seen has had a clause about criminal behavior, if the tenant is a sexual predator that is criminal behavior. If I found out I had a sexual predator living on my property I would go above and beyond to get them out of my property.

I don’t live there but I would think as long as u told the landlord and not in any violation and have a lease maybe talk to a lawyer but that will probably cost more than just moving somewhere else.

Unfortunately, a person charged with something like indecent exposure, ends up on the same “offender” list as a rapist. They can evict you if they have a clause in the lease about criminal behavior and they are required to evict if your within a certain distance of a school or public playground. Definitely best to speak to a lawyer.
