Not sure where you are, but in Texas you don’t have to give them a 30
Day notice. You do have to give them 3 days. Now if they don’t leave in 3 days, then you have to go and PAY at the Justice of the Peace (JP). They will issue an eviction usually 3-5
Days. Then if they do not vacate at that point, you have to go back to JP, pay AGAIN, and they will have another 3-5 days, and at that point, they don’t leave they send the constable over to remove them.

I know in Alabama , if someone receives mail/ and resides at the home , you have to go through an eviction process . But if he doesn’t contribute to bills , nor receives mail there I’d say kick him to the curb . The only way you could have issues is if he takes you to court .

I hate to be the bearer of bad news , but you have 2 options…1. If you are scared of bodily harm or he has neglected or abused you or your child. A restraining order may be the easiest way out of it. 2. You have to go through the courts and evict him ( a very long process) sorry.

Of course you can ask him to leave but legally he’s a tenant of the house if he’s been there over 30 days. He can refuse to leave and you’ll have to go through the courts to evict him.

I believe you can ask him to leave especially since he doesn’t pay any of the bills. My understanding is if he receives mail at the residence, you will have to have him evicted

Do it legally and give him a thirty day notice. Send him a message by email or text so you have proof it was sent if he tries to take you to court. After 30 days, if he has not left, pack his stuff up…taking pics of his things and place them in a safe area, message him to tell him where his things are and change your locks. You are most definitely right to want him out and as everything is in your name and you are paying all the bills, it is your place. Move him out of your bedroom, and no sex, that will just lead him on. Let him know you are done with him and if during his 30 day period he starts doing things that are unsafe for you and your child, call the cops and he can finish his thirty day notice elsewhere. If you are worried for yourself and child, contact your Landlord, explain what is going on and ask to get out of your lease. If the Landlord has another apartment/house you could rent and you can afford it, take it and let your ex have the place just for your peace of mind and mental health. Call the utility companies, explain you have moved, turn everything off in your old place where he is living and on in your new place. Has he ever paid rent? If not, check your State laws, you may be able to just put him and his stuff out with warning…l but if he wanted to be a dick he could take you to small claims court, which is why I say do it legally with a thirty day notice. Good luck, and stand firm! Imagine being such a pathetic pos he cannot even own up to what he did and has to blame a child. Why woukd the chikd be interested in that? How would the child know to ask for them? If it was from auto suggest, man chikd must have written that request out a few times, so needs to be kicked into the real world. If you are still in doubt though, contact Citizens Advice in your area, they can give you all your rights and his, and can even get you in touch with a local lawyer who could give an hour’s consult free or very cheap depending on your State and your financial situation.
