Do my parents have a right to claim my daughter?

If u not filing taxes to claim your child let them and tell them that’s your share of the rent. 6 or more months u dont pay rent.

Sounds like you are living under their roof and they are paying all the bills supporting you and your daughter, if so they could claims her as a dependant.

They don’t support her so they shouldn’t claim her

They have to get a paper signed by u saying you give them permission so if u didnt and u claim them they have to pay it all back went through this already so thats up to u

Talk to a tax advisor. Seems There is something missing from the story here…how are you a “stay at home mom” on a military base, living with your parents? I thought it was for enlisted and their dependants…or are they claiming you as well?

It seems more likely they would get in trouble for renting space to you.

I doubt they can claim your daughter of they aren’t the legal guardians.

I’d call the IRS and find out what they say…u may be going against the law if they claim her and they do not support her especially with you paying rent and for all things you and your child need.

File your taxes before they do and if they try to claim her then their taxes will get bounced back.

Actually they have committed tax fraud by claiming her without a court order or your written permission to do so. I would sit down and let them know that it had better not happen again or else you will file charges for fraud.

Tell them she’s your daughter and you are claiming her. ( that will avoid red tape in the event you both claim)

If your on a military base why are you paying rent??? Your parents dont pay rent power or water living on post so why are you paying them rent that’s considered fraud if you ask me .

The law is that you paid for over half her support, you get the tax deduction.

They have to be her guardians to claim her did you sign away your rights to her ? Tell them no! Then move out!

You absolutely won’t get in trouble if you claim ur own child… altho if u don’t work, you have no taxes to file??? Why not let them claim her since no one else technically are? I can’t see how the father of the child can cuz he’s in another country & as said you didn’t work so you have no taxes to file!! If no one else can benefit from claiming ur daughter… why not let ur parents claim her?? Confused?? :thinking:

And you don’t have to pay rent they live in military housing it’s against the law they charging for the rent but paying for food need to move out if parents doing this to you they want money

If they haven’t supported her for 6 months or more they can not claim her and you can contact the irs and make sure they dont I know here you have to have ss card and birth certificate plus a written letter giving permission I would not let them you are the one supporting her not them

If you provide for your child she is your defendant and if they falsely claim her they can be prosecuted for tax fraud.

When it comes to adult children living with parents especially on base. You are not providing close to half support for you or your child. The food you are providing is mostly lightly food stamps.
Yes your parents can claim your child on there taxes.
The child’s father is British citizen if he’s supporting you and your child you would have your own home. He is putting all his money into the visa in process. The crumbs of money is sending you know it not supporting you and your child.
Both your parents are probably both working and you the stay home mom. I am sure since you live with your parents you have left your child with your parents you live in the same home. I seen too many times adult children use there parents. But the adult children make it like I pay rent but food and clean the house. All I can say is grow up get your own home

Are u listed as a dependent and on their medical?

They can’t your child no matter what they think. You may have to a lawyer or the IRS involved. But don’t wait.

No they sit have a right and yes they can get in trouble for claiming them illegally

I am still trying to figure out how you are a stay at home mom, pay rent, but no job.

If you have no income, what would you file?

Who paid for the birth of the child and all her medical bills and yours. Who pays the utilities and rent if any. There is also cable, internet, phone and etc. when you say food do you cook and store all your food Separate and cook for just yourself. Where do you do the laundry and who pays for it. If you can do all this and pay rent without your parents help move out then claim yourself and child until that be great full that they let you live with them.

If you file before they do you will get it. You can’t get in trouble unless they are supporting you too.

Contact the IRS . KEEP ALL YOUR RECEIPTS . IF YOU ARE THE ONE THAT IS PROVIDING FOR HER YOU CAN CLAIM HER

My mother did that to me , I paid her monthly to live there. SHE was audited by the IRS .

They can not claim her. Especially if u gave proof that u pay rent…

They would have to claim rent as income.

If you have no income you do not need the tax deduction. If you declare income taxes you need to claim the child, if you do not, then someone is entitled to claim her, you can work out in exchange how that will work financially with your parents and you should be very grateful that they are providing you with a home for both of you even if you pay something. If you are not employed, it is hard to believe that you have much to contribute to the room and board situation for you and your daughter.
