How long did it take you to get back child support?

For the moms who receive child support and live in Ohio, did your BD get his back support taken out of his last year’s taxes? And if so how long did it take for you to receive them. I have five kids with him. It would be nice to have the money soon. Thank you

He did file his taxes, it said in the letter that it was take out on April 24th, which was 6 weeks ago. I called the CS office and they said it would take 6-8 weeks, but wasn’t sure what others experienced.

It can take up to 6 months IF they took it.

If he filled taxes you should get the return as soon as they catch it

I got mine in less than a month also from ohio

Usually 3-6 months after they file. If they catch it.

Don’t forget he doesn’t HAVE to file…oh and they often adjust withholdings so they won’t see a tax return.

Depends on how far behind he is, if he actually filed,when he filed when irs accepts etc.
Just to get our taxes took 6 weeks from file day.
Honestly there’s a lot of variables to your question to give you an exact date.

My husband filed taxes and we’re still waiting for child support to say they got it. If they do he will be paid off for sure by next year but even we’re still waiting for child support to just take the dang money so we can be closer to paying it off and buying a house.

Sorry if this doesn’t help but I’m In pa they don’t take from taxes unless they owe at least 1500 in arrears. If they are, usually 4-6 weeks to receive.

In ohio here. We filed our taxes march 29th & still haven’t gotten our return. I also haven’t received my exes back support yet either, bit I doubt he filed.:expressionless:

im getting back child support still getting back support for a 25 yr old seem took for ever but never got from his taxes was suppose to have. because he quit jobs starting working under the table courts had to hunt him down but they made me search for him considering i havent seen him sense 2009 maybe 8

Depends. If they are single they intercept the taxes right away and deposit them to the child support account soon after. If they are married and file a joint return, they intercept them but hold on to them for 6 months because the spouse has an opportunity to resubmit the tax return with an amendment as an injured spouse… which would take their portion of the return back to be given to them. Since it’s not their debt, they’re still entitled to their portion.

In OK they hold it 3-6 months

In Oklahoma but,never really got mine, he pays like $3 a month towards the back child support so good luck lol

I don’t live in Ohio but for my state they will only take his taxes if he’s 12 weeks or more behind otherwise it’s an extra 75 a month. Every year he’s been behind though I have it by March, April at the latest. They can arrest him and take his license where I live but I think that happens mostly if the parent that gets the child support makes a deal of not getting it.

I wouldn’t sit around and wait for it… In my situation, it will never come… don’t expect it. The system doesn’t make him pay… He works under the table… he never filed taxes. Good luck to you though…

Sorry. Speaking from the other side. Yep u are entitled to it. That being said my husband was arrested and fired and drivers license taken away. Seems ok right. The ex already took the house and land he bought and paid for. I’m new wife. Got them off his ads so he can pay 1200 dollars a month. I understand takes $$ to take care of his children. Why should she sit at home in the house bought and played for when he has a new son with me ? And she remarried 2 weeks after their divorce so that man sitting pretty too. Its been 20 years later and this woman has collected $900,000 dollars because she can.

I feel you. My child’s father owes about 80K in back child support. I doubt he’ll ever pay. Thank God I’m not sitting around waiting for it.

If there’s an order in place that involves arrears, you should receive any tax return he may receive year after year, as well as the first stimulus from the pandemic.

We are in Ohio. My guy has had custody of his son for the past 4.5 years, and they still take every penny of his taxes. + all the stimulus payments that have been given. She gets money for a child she didn’t take care of while she had him. And, hasn’t spoken a single word to him since he got custody. But, keep in mind this girl has 9 kids by 9 different baby daddies, (my step son is the oldest of the 9) and she literally depends on the Government and child support for everything. She has NEVER HAD A JOB. She just started having babies. I guess it depends on the state. Because, he is less then 10 grand in arrearages and they still take every penny they can. They just recently emptied OUR bank account, never mind the fact that there’s an infant who needs to be cared for, and the fact that he pays for every thing that he needs/wants/eats.

My dad owed like 60k. IRS caught up with him one year and my mom got sent a 10000 dollar check I was 17 (haven’t had contact with him since I was 6). When I was 23, he filed for social security disability. I was given 1500 bucks, my sister was given 1500 when she turned 18. After that he back child support was taken out until it was paid off to my mom.

In alabama they’ll hold it 6 months minimum just in case any of taxes was a spouses earned taxes and they file injured spouse

I feel like child support only goes after the people that pay…My ex owes thousands my son is 22 now he somehow figured out how not to pay…My husband paid his support he fell on some hard times and ended up on long term disability well checks would come late then child support would be late and he’d be getting a letter threatening to incarcerate him…

I know in VA they hold it for six months to give any other potential kids parents an opportunity to claim their portion of the money. Example, if they have more than one child support case in any state.

I’m owed 27,000 in back support, he works under the table. So I’ll never live to see it. I’m from ohio also.

I live in Ohio and I recieved his tax refund last year and was supposed to receive the first stimulus check from last year but still never received it. Called child support they said call IRS. Called IRS they said I was supposed to recieve it and I told them I never did and they were like you will get it when you get it :woman_shrugging:. Here it is early June and still nothing

Unfortunately in California you almost have to be a detective because If they can’t find him they put it on the back burner. Also for the deadbeat mom and dad’s that refuse to work so they don’t have to take responsibility. They end up selling drugs, stealing because they feel what is yours is theirs and cheating to avoid paying child support. I know a couple who owe over 30k and child support hasn’t done anything. Even if they did suspend his license they would just drive without one.

I know in texas when they take his taxes after the state gets it its 180 days till the other party will see it

I’m not in Ohio but in my state they are only allowed a certain amount of time and amount until warrants go out as well of suspension of the license.

I have permanent custody of 2 nephews. Neither father nor the mother make any payments. The oldests dad is 55k behind in support (and about the same for each of his 2 other kids). I bust my ass and dont worry about it. I took on that responsibility and no one is going to make me fail. I suggest you do the same. Stop looking for a handout and take care of urs. While a good father WOULD help support their child, 9 times outta 10 it aint gonna happen. That means u will need to step up, plain and simple

I’m in ohio. I never got it out of his taxes. The few times he did get behind they just took an additional 50 a month from his check until it was caught up… If they do attach his taxes it’s only state taxes and those aren’t usually a lot… so don’t count your chickens

If you get public assistance, they subtract that from what you get unless laws have changed so I wouldn’t be sitting there waiting on a huge check.

Here in CA, we got notified that we are going to release the held funds finally.

So many men quit a job when CS catches up to him. Work under the table. They always find a new one to have a kid with.

In Kansas my ex owes me 5 years of child support and he lives in Iowa. The website said it took his stimulus and tax return to pay for child support but I haven’t seen a dime of it.

I know someone whose kids are all grown and their father owes $70k in back child support. So maybe never.

My hubby was about 9K in arears, he recieved 3 separate insurance policies when his mother passed and the state of Texas seized all 3 policies and paid the mother the arrears owed (without our consent) even tho my hubby was making payments. He was automatically in arears when the mother filed for support (the kid was aged 17 when she filed expecting a 100,000 payment. State only granted her 10,000)

It’s till he does his taxes. Then usually less then a month after he files.

I’m in texas and my ex filed with his gf (she has two kids and got the child tax credit) so that took her refund and I got it around 8 months later.

I always get it about two weeks after he would.

They release them once a month. Can hold it for up to 6 months.

For me it took 4 weeks from the date he received his refund.

It can take up to 6 months after he filed.

This why I got my ex taken off CS all together!

I’m in Missouri. My ex was so far behind, they suspended his license, that didn’t work he still didn’t pay and they ended up arresting him and he was charged with a class D felony for failure to pay.
He is slowly but surely paying his current child support plus some towards arrears. In my case he was also later again arrested due to drugs, got another felony, did some jail time and probation and I think that played a large part in him maintaining a job and actually paying support.

A note for you: don’t wait for the support and count on it as a means to help you with bills and such. I gave up on that years and years ago. I just decided if he paid, hey it’s extra but I didn’t need or expect his support to be able to pay my way. Yes it sucks, yes he helped make those kids, but you’ll be much happier when you don’t give two shits if he helps because you aren’t “depending” on his worthless ass

For anyone who clicked on the laughing emoji, you’re despicable, child support is reimbursement for money that the mother spends or the father in certain cases, trying to figure out how to make your life easier and the life of your children easier is not a laughing matter, this woman didn’t choose to have these children alone and she shouldn’t have to shoulder the burden of caring for these children alone, men like this should be jailed!

First of all, he is the father of your children. NOT a “BD”. There are many work from home opportunities on indeed.com or you could run a daycare to make money. Not to mention, you probably just got a tax refund and will be getting an additional $250 a month per child from the government soon. NEVER expect to depend on child support! The county doesn’t care about the kids you brought into this world - so, bust your ass and show those kids who the REAL MVP is: YOU!

If they took his taxes, I believe the standard wait time is 6 months that the state holds the funds to make sure another entity is not entitled to them. It’s so frustrating.

In my state, if they owe arrears and have at least 4500 in checking or saving, it can be wiped out. Happened to my boyfriend just before Christmas and Happened to my 18 year olds dad yesterday

Never! I finally forgave the $20,000 arrears because it’s a pain and hassle to get anything out of it. Waste of time!

My ex owes over 20k for our daughter . He won’t work but when he did the state intercepted his taxes. I wouldn’t count on it thought

In my credit they go after my state taxes. (I pay child support on my two oldest children. I got behind when I had a baby in 2019 and when it first started and I was homeless like in 2015 so I didn’t get mail till they took it out of work checks.). I’m in MI. But I was only behind under 500.

I’m on 14 years of no support never seen any money from my sons dad. I gave up after having him served and doing all my parenting classes that were mandatory

Idk if it’s the same for all states, but in Oklahoma, a tax offset is held for 6 months and not a single day less. Then they take what they’re owed first, so interest plus the monthly $10 fee plus the yearly $35 fee. Then the custodial parent will get what’s left. If you don’t have it at the end of the 6 months, call them nonstop until they release it because they WILL try to keep it if they can!

Only time I ever get back child support is if it’s from his taxes. I live in PA though and also they can’t touch it unless he’s owed over 1000 in back support

Not sure how much of a help this is. My fiance is a few thousand behind for losing his job last year and his unemployment wasnt enough to cover living cost and child support I talked him into doing his 2019 and 2020 taxes well needless to say she got a nice 2,000 check from it he got paperwork in the mail from the irs saying his taxes went to child support. Depends if he did his taxes or not. My son is 13 years old and his dad has never done his taxes ive never received nothing extra just regular weekly payments which im grateful for that some moms get nothing

They can legally only take 50% from what I’ve been told, and if you received any kind of government assistance (ie families first) then they automatically pay that first. Because that’s actually a loan against the father for the mother to receive help until child support takes affect. Just like they can legally only take 50% of his paycheck for child support. If you’re receiving child support through a court order, contact your case worker to find out if you’ll get any of the income tax. If it isn’t court ordered and only a verbal agreement between the two of you, chances are you’ll never see it. Been battling with child support office for two years for my daughter. I’m lucky if I see one payment a month.

check your state due to covid many rules changed. they may not have taken out the back child support this year. in my state it is not held but this year I didnt get it due to the temporary rules. this is not automatic you have to file a lean on the taxes.

My ex husband had a $7000 tax refund taken for child support owed to his 1st child’s mother in 2019. She still hasn’t gotten it. Her and I are friends now so I know she didn’t get it .I’ve seen her support statements. I wouldn’t count on anything.

I get my child support from my bd taxes and I get it on August 31st every year. Mine come out from Nevada. They only give me the amount from the previous year tho even tho he owes from previous years

Mississippi said they won’t be releasing theirs till September so it might be a while

In VA they hold it for 6 months to give the non custodial a chance to prove it’s either not owed or the amount being held is not owed.

Hah, I don’t know about Ohio but NATIONWIDE, I wouldn’t count on it until he’s officially thousands in arrears and they’ve already taken the previous steps to collect. It isn’t automatic that they take their taxes, there’s a whole process that has to come before it and it can take YEARS. also, if he pays regularly, or it’s garnished from his check, they don’t automatically garnish his taxes.

Were they born on state insurance? Medicaid? If they were, they may just keep it all. That’s what happened to mine. If their birth is covered by state health insurance, the state will take what they can for the birth as payment. If that is what happened, you may never even get it. And there is nothing you can do. Been there a few times.

For me my ex is remarried so it takes 6 months for to me to receive garnished taxes. This allows the new spouse to file paperwork to get what is theirs.

My dad owes my mom almost half a million dollars (no exaggeration) for 4 kids. In NJ if you don’t mind doing your 14 day stay in county every once in a while you don’t have to pay child support apparently.

Omg that’s horrible, I live in Indiana and when my dad had to pay child support they just took it out of his checks from work!

I live in Ohio and i got (a portion) of my ex’s back owed child support from his taxes, they will always take it out of their taxes if they are behind on child support
