Will they even take someone to court over $ 300? I don’t think he’s right but if he pays monthly normally I wouldn’t take it to court my ex owes over $30,000 and I have never taken him to court they did once and they lowered the payment amount bc he “ wasn’t able to pay” I honestly don’t care and don’t want anything from him my kids have everything they need. 
I think if you have peace and you have all you need way start a court trail isn’t that stressful to you as well?! I would rather not deal with it personally.

Not sure what state you are in but if he is behind on payments you will get it anyway I got my exes first stimulus he never saw any of it.
If it is a court order for him to pay a certain amount dont worry about it. The courts will know what he sent to you . an if he is behind on any payments he wont be getting that 600 always. It will be sent to you. I know this because the father of my child did not get any thing from the goverment

He owes you the $400, no matter what, and besides he’s getting a stimulus as well, unless he’s rich as heck, but than again if he was, you would get more than $400 a month. On my child support they don’t have a choice. Its taken directly from the stimulus before they receive any. Same with their paychecks. Its automatically withdawrled before they get their checks.

Whoever claims the child on taxes receives the 600. So if you have primary custody, and claim him or her that money is for you. If he claims the child the money is his. That is how the court sees it. I have been through that exact situation. There is no grey area.

If he had the right to anything obviously the courts would of set it up and give it to him, which was not the case. If you basically have primary custody of the child then it should go to you for he or she is living with you. As for him if you have already been to court i suggest you tell him you will take him for another round (which i doubt he will want to do, seeing as he was entitled to pay it and is going against orders) and he will pay what is owed if he chooses to go back to court hell just owe you for the times he didn’t pay the full amount and will just have more against him. So either or it would be a win win for you just make sure you have the proof that hes only giving you 100. Then call your lawyer. Good luck!

No, he’s court ordered to send a specific amount. Anything he sends would be considered a gift. If he is behind child support will garnish his portion to pay toward the amount he’s behind. Any amount he sends to you directly, report to the child support office. Tell him to deal with the child support office and the courts.
Been there before.
Whatever the IRS and fed government gives to the parent who has residing custody does not negate his responsibility of paying said amount of child support.
In the courts eye, he is still to pay the written, agreed amount, regardless of what the federal gov gives.

The stimulus check has nothing to do with child support. He is still responsible for his court ordered support payment in full. Does he not get it taken straight from his check? Makes it so much easier and he can’t pick and choose when and what to pay. He isn’t entitled to anything if he isn’t the primary caregiver. That money is for helping with the cost of raising those kids.

Your children deserve to know that both parents will support them. If you let him get by with this he will think of other ways to disappoint your child.
Also look ahead to the future. My ex promised his kids he couldn’t contribute toward school trips, etc because he was saving for their college expenses. Every time we asked him to chip in on a special occasion he would write a note or letter saying that he was saving for their college.
Three days before my older child graduated from high school his attorney called to say the ex was not helping because she had gotten scholarships for tuition. She still needed expense money and a car.
So I sued him. I had saved all those letters and notes he had written.
I figured that my child had earned her share in those scholarships. I had paid 100% of my income to support my kids, home, and my work expenses. He paid only 17% of his income, $300 per month total for two girls.
I figured it was his time to keep all those promises and pay his share of college expenses.
The judge agreed. We set legal precedent when we won the case. He had to pay $400 per month for each child until she got a BS degree in the studies they chose.
The judge deliberately wrote the decree without too many details nor too much money so it would not be overturned on appeal.
My girls each took 5 years to finish their BS degrees, and each worked to help pay more than their scholarships covered. They each went on after their BS degrees to get a couple other degrees, including MBAs, Master degrees, and high levels of training with their employers. Both are respected and responsible.
Your spouse can be required to pay college support. The case your attorney should cite is
Irwin vs. Irwin, Jackson County, Mississippi, Pascagoula, MS. from the year 1987.
You can reference this case in any state of the USA and you would have a very good chance to have a decree to require the ex to do what he should have wanted to do without being required by a court of law.

If he is court ordered his little text message to you don’t mean shit, I been there my mom had to force my father and my brother’s dad to pay child support and the court pulled money out of their bank accounts and if they was unemployed they would pull it from there and they was both forced to pay until we turned 18 and graduated from high school
