What should I do about what my doctor did to me?

My baby was born at 39 weeks one day with no known health concerns at all …My last ultrasound was at 25 weeks after a third anatomy scan due to not being able to see the babies heart fully the doctor told me that everything was fine. Fast forward too nearing the end of my pregnancy I felt like something could possibly be wrong and asked for another ultrasound almost every appointment I was told no my baby is a Csection baby so there’s no need to have another ultrasound… shortly after birth we learned that the baby had severe heart issues which would entail three heart surgeries 2 being open heart , starting at less than 2 months old and eventually a heart transplant kidney & liver transplant as well. We spent the first 12 hours with her before they noticed this and was taken and rushed to the childrens hospital , We spent the whole first week in the hospital at Vanderbilt children’s. That week I received several phone calls from my OB to check on the baby and myself ( which being my 3rd pregnancy I can say this is the first time iv ever had an OB call to check on us at all) when I went to my follow up that she requested at 2 weeks which was also strange to me she shows me an ultrasound of my baby’s heart… showing that it was fully formed and claims she’s “unsure of how this could have happened” I was shocked when I seen the picture so I took this to the baby’s cardiologist where we were told by her there is NO WAY my baby’s heart ever formed that she 100% did not show me a picture of this baby’s heart … So that really raised some red flags for me because if you missed it just admit it and move on … Everyone is telling me I need to sue this doctor for negligence but I’m not sure if I should or even where to begin fast forward to this week I went to my 6 week follow up and took the post partum depression quiz and was diagnosed with MILD PPD this dr has tried to admit me to the mental floor at the hospitals went as far as trying to refuse letting me leave my appointment , has had a physc hospital contacting me , the medical center and also her office … also went we as far as calling my husband more than 5 times in one day while he is working if I don’t answer because they are “afraid I may harm myself” and I sort of feel like she’s trying to get me admitted incase I try to sue she will be able to use my mental state against me :upside_down_face:

Find a Dr you trust.

It definitely sounds like she is trying to cover her tracks. For sure sue , and reach out to an unaffiliated mental health professional who can attest to you being in a sound mind

In alot of cases, you can’t always see damages until the baby is born.
That said, she sounds shady.
Talk to several lawyers and sue her. Stop contacting her and let your lawyer handle her.

I mean the ultrasound wouldn’t have done much but let you know what was going on before the baby was born. Often there are issues that go undiagnosed on ultrasounds. I am so sorry about your baby :heartbeat:

I know your trying to find someone to blame. But your doctor could of did every scan you wanted and still not have picked it up. My own daughter has heart issues and even tho I was already high risk and seen many doctors and specialists. I had so many ultrasounds. They still didn’t see my daughter heart issues on any of those scans. Try and focus on your babe. That is who needs you now.

Call an attorney ASAP.

I would defiantly contact an attorney first , know you’re rights and have all the facts . That way she can’t have you admitted because you will be protected . Sounds to me she knows she didn’t do her job and is now trying to cover what she’s done . Also I would no longer use her as an op , I would contact another op set up an appointment and have your paperwork forwarded to their office .

You absolutely need a lawyer and need to sue that Dr for negligence and now harassment if it’s the same Dr trying to stick you in a psychward. Sounds like they are trying to make you out to be crazy so they can claim they did their part but you know they didn’t.

I would be getting legal advice. Thats red flags!
I am a mom to a child with sever and complex heart defects which were picked up at my scan but I do know they can (yes even complex ones) can go undetected. I see way too many posts where the parents learn about CHD from the corner.

I wouldn’t sue. She missed it. What could have been done if she had noticed the heart problem? Had a c section earlier to operate on the baby? Or Would you have aborted instead of having the baby? If the first just think of it as you carried the baby to term and needed surgery. If the second I can’t help you there. But regardless, work on he as king your mind and your heart right now, nourish yourself with food and supplements so physically you feel good. Anybody in your situation would feel blue.

Unfortunately you can only blame the doctor so much for the heart diagnosis. Ultrasounds are helpful, but not fool proof. I would have continued to raise concerns or booked myself an ultrasound somewhere else. All the stuff afterward, you may be able to file something for, but is it worth all the stress right now? I would find a new OBGYN ASAP so you can move forward, and stop all contact with that office.

My baby had an undetected heart defect. Heart defects are the most common defects and some heart defects are not evident until the baby is born, which was the case with my baby. The only way you’ll feel better about this is if you speak to someone. Call the hospital and talk to the president or someone on the board of directors. If it makes you feel better a lawyer.

I’d last least get some free legal consultation. In cases like this, some will work for ‘free’ until the judgement is awarded (and there are some good 'you don’t pay if we don’t won’t type lawyers, ask for referrals)

Find a new ob/gyn and a pediatrician. Look into medical malpractice attorneys for a consult to see if you have a case. Your county may offer legal aid.

Isn’t it illegal for her to call anyone and tell them anything about your appointment or medical issues. I feel like that’s a violation of hippa itself.

She’s trying to make it seem like your too bereft to understand what is happening document everything she’s done trying to get you diagnosed in a comparative timeline to what happened to your child cause court will see the connection. At this point what she’s doing can actually lead her to jail time at this point; intentionally false diagnosis and harassment

Nope! Lawyer now asap! Protect yourself. I got the vibes she’s going to do that before I even read you’re aware she might even try ro use thst against you. Only a lawyer can help you through and navigate this correctly. And yes I would sure af sue her ad well.

This is a not right . I think YOU are right that they are trying to use your mental state against you… I was 28 weeks when I got an antidepressant because I couldn’t take being without any antidepressants. I think I probably looked admit-able ( I don’t think that’s a real word :joy:) . My ob didn’t try any of that . They never called me or my boyfriend for that matter either .

Some issues aren’t always found. I was told my son was a healthy baby girl, HE was born with one of the rarest genetic disorders. He’s missing a kidney, had some heart issues, and facial deformities. I had ultrasounds done at different locations and nobody picked up the issues.

I am so angry for you because that’s definitely not okay for any of that to just have been pushed to the side & considering all you’re dealing with now with a medically complex baby, I would be struggling with my mental health, too!! Oh wow you are spot on they are trying to use your mental state against you this is what they try to do alder hey done it with me saying I need psychological help when in actual fact I don’t they just need to be doing there jobs properly with my kids xxx

The dr is def acting shady but she didn’t cause the heart, kidney, or liver issues your sweet little one was born with.

Definitely get a lawyer. Also get another opinion about PPD. Because I feel like mild is no reason to be admitted the way they’re trying. Being a mom in general is hard, but your situation is a whole new level. My heart goes out to you.

Was your ob even the one who did the ultrasounds? I’ve had 3 babies all in different practices with different Drs and my OBGYN has never been the one to do the detailed ultrasounds. They were performed and read by another dr and the results sent over to my dr every time. Maybe your experience was different though :woman_shrugging:t2:

Yes sue! Then she seems to be trying to have you admitted now? Sue! Plus if you do win you will need help with all those medical bills, and also seek another OB! She can not force you to do anything, and even if you were going to be admitted find another hospital away from that crazy OB!

I am sorry for what you & the baby are going through… but this is a decision that you & your husband need to decide between you 2, not be advertising on fb. Take care of yourself & that little one & decide with husband & family if choose to on what to do.

She showed you someone lies ulrrasound to try to convince you she wasn’t negligent. Now she’s trying to have your mental stability put into question so your concerns for negligence are dismissed. Contact a lawyer ASAP. Document everything. Sue her. And don’t stop until she has her license revoked.

Lawyer up right away. To many doctors get away with not listening to the patients concerns. And patients are always too scared to speak up after health issues pop up that could have been avoided. Be your baby’s voice

Get yourself a good lawyer.

Quit seeing this OB and take your baby to a different cardiologist that no one from your past is involved with.

Pretty sure a lot of heart conditions can be undetected during an ultrasound :woman_shrugging:t3: not sure about kidney or liver problems though. I wouldn’t necessarily go with suing right away. Definitely talk to another doctor about everything that’s happened and see what another doctor has to say, if they tell you that you need to sue then go about getting a lawyer

Any mother would be SITUATIONALLY distressed over what you are going through. Contact a medical malpractice attorney, most of them do pro Bono work with a free consult. And stay away from that OB.

Just get a good attorney skilled in medical claims and sue. The time spent talking about what has happened to anyone other than a lawyer is wasted time. Your baby will have ongoing medical needs… time to make sure you can financially cover every cost to give your baby a beautiful life for many many years

I have questions and concerns off the bat. From my experience with my 4 kids and my group of mama friends all ultrasounds are seen by the ultrasound tech and then sent directly to a peri neonatologist or a neonatologist - not the OB. So I’m already a little weirded out these are going to someone who may not be that familiar with seeing them. Second, sometimes heart issues cannot be clearly seen or develop over time - the scans are not 100%. Third, that a doctor has been contacting you like this is serious cause for concern - I would stop all contact and talk with a lawyer asap - conduct alone is more then a flag and with the situation because it could be a malpractice issue - stop all contact with the office.

You need to go to the medical board that oversees this doctor. You need to let them know you are being harassed and it needs to stop. Also, all of this needs to be written down before you forget it (includes dates and times of the phone calls made), pull your phone records for proof. Something doesn’t sound right, not sure if an attorney is the right path but I would definitely document EVERYTHING at this point and also look into your state’a statue of limitations so you know how long you legally have to make a decision.

I would definitely contact a lawyer just to see if you have a case. In the meantime stay away from this Dr. Don’t answer the phone tell your husband not to answer. And I’m sure you do have some mild depression with everything going on. Hang in there.

Honestly, I would sue for malpractice (even if it was unintentional on the doctor’s end). My health is complicated, and I have done a lot of research to finally guide my practitioners into testing what I need after being a test dummy that only got worse for 15 years. I have learned to tell them to note in their report that I requested a test, and I was denied. Funny how that is what finally pushes them to do it.

It’s nearly impossible to sue doctors/hospitals. I found that most lawyers refuse to take on the case for that exact reason. My baby was born premature and the NICU only kept her for 19 days. 6 days after being home she died unexpectedly. They failed to tell me she had apnea of prematurity and did not send her home on any monitors or anything. I was wondering why the discharge nurse seemed so hesitant about our long ride home but didn’t think anything of it.

But what doc will not Give you n ultra sound after 25 weeks especially if you requested it that’s not right they should have gave you one without request to check on baby. I would definitely be calling a lawyer, calling the hospital, write every thing down, keep records of everything litterly. ,also get you a new doc , also no more contact with this lady. Wow that sounds like a crappy doctor. They saw spots on my babies brain and in that appointment they set up a appointment with a specialist. We found out it was nothing later on but I’m so glad they did that for me and my baby. I’m so sorry they neglected to do something and honestly I agree with everyone. Do not let this doctor get away with it.

Talk to an attorney they give free consultations and go from there. That is not okay at all

My son had undetected heart defects and a birth DX of Down Syndrome.

Ultrasounds & test aren’t 100% & more of a guessing game. Stuff gets missed all the time.

You can try to sue her BUT it won’t be for not dx your baby. It’ll be more of a civil suit.
Make a complaint to the medical board, find a new dr & focus on your baby.

Lawyer up n i may be wrong but i didnt know a obgyn can diagnose someone mental id also get another opinion from a professional js because it sounds to me exactly what u said she trying to get out of being sued showing u false ultrasound of ur baby heart ect trust the cardiologist about that dont let 7 years lapse before u do anything i found lot 7 years 2 days to late that because of neglectance of my obgyn my 2 born was born dead n it was kept from me hid from me she was revived n lived but has suffered problems from it wish i had found out way sooner than i did Prayers for ur baby n you n your family

I would find a new OB pronto and explain all of this and have the new OB evaluate you. Also get an attorney. I see so many red flags. She is def trying to cover her tracks.

My kids both have VSDs. VSDs are holes in the heart. They were DX around 19 weeks. They would have definitely noticed a total malformation of the heart. They missed something. Get a full copy of all medical records from the OB now. Check your scans. See if you have any of the pictures they sent home from the appointment.

Lawyer! And with thir guidance lodge formal complaints to the appropriate authorities with as much evidence as you can gather. Protect yourself hun because it sounds like you’re being lied to and rail roaded

1.I’m 80% sure you can’t sue for the ultrasound things.
2. You can possibly charge with harassment
3. It’s deformation of character if he’s trying to admit you and calling other people.
4. Send an email to his office saying you want no further contact with himself or his clinic and that you’ve found another doctor whom will be requesting your file with no charge to yourself due to the harassment that has taken place

Don’t give Dr’s that much credit. She told you they didn’t get a good view of your unborn child’s heart. So she had no idea your baby would be sick at birth. As for the office staff and the OB checking in on you after finding out how sick your child’s heart is, that’s normal. What did you tell her about your mental health? PPD has a different protocol than normal patients who do not have PPD. They ask you a series of questions then determine how severe your PPD is. In 34 years of Healthcare working 15 at an OB office, I have never in my life heard of a Dr trying to admit you to a psych ward for mild PPD. Did you say you felt like you wanted to harm yourself or answer the questions as such? There’s more to this. I’m sorry about your baby. It may be a good idea to consult with a malpractice attorney just for piece of mind. But you saying that the Dr told you they didn’t get a complete view of her heart from the last ultrasound which I am sure she documented in your chart may not give you a case. Sometimes it’s just nature not anyone’s fault.

Get a lawyer and definitely get a second opinion on you PPD diagnosis (she could be lying to cover her a$$)

Not sure why you need a lawyer. None of those conditions have anything to do with what your doctor did. One of my twins had VSD, and we didn’t know until he went to the NICU for low blood sugar a few hours after birth. I was high risk and had ultrasounds every 2 weeks until the last 4 weeks, when I had them once a week. I wouldn’t sue my doctor for my child having any type of medical conditions unless it was something they caused.

I have a few issues with this.
Ultrasounds show the patient name and date on them. If it’s your ultrasound, you would see that. If the name and date were not there, why did you not question this when the dr was showing it to you? Because yes, that would mean it wasn’t yours.
In all reality though, there is nothing that could have been done, regardless of how the heart was forming. If it wasn’t forming correctly, and the dr acknowledged that at the time of anatomy scan, it wouldn’t change anything. Your baby would still have these issues now. You just would have known and stressed even longer. Still same end result though.
Furthermore, some things don’t show on ultrasounds. Only so much can be seen.
If you’re questioning the dr, about the scans and mental health stuff, find a new one.
Aside from that, love your baby and be thankful they are alive. Surgeries or not, things could have turned out so much worse. Just do what you need to do to keep up with medical care for baby outside of the womb. That’s the only thing that matters now. During the pregnancy itself, you’re very limited.

It really just might not have been visible through ultrasound. The doctor has no reason to not want you to know before birth that the baby had heart problems. What would you sue for? The baby’s medical problems weren’t caused by the doctor. Unless you would have had an abortion if you had known? Having 3 anatomy scans, I’m guessing it was too far along for that tho

sue!! this is complete negligence. she’s lucky your baby is alive. I’m so sorry you and your little one have to go through all of this. She needs to lose her license this behavior isn’t okay.
